KANPREDICT LLC — Terms of Service

1. Acceptance of Terms

By accessing or using any service provided by KANPREDICT LLC ("Kanpredict"), a Delaware limited liability company located at 16192 COASTAL HWY, LEWES, DE 19958, EIN 88-3173291, you agree to be bound by these Terms of Service. If you disagree with any part of these Terms, do not use our services.

2. Service Description

Kanpredict delivers software-development services featuring automated AI scoping, transparent upfront pricing, and guaranteed delivery timelines. Each feature is delivered as a merge-ready pull request validated by internal quality assurance.

3. Pricing and Payments

Fees are displayed upfront before you initiate work. Pricing is $599 per repository. Payments are processed securely through Stripe and must clear in full before delivery begins. Prices exclude applicable taxes unless stated otherwise.

4. Feature Delivery and Acceptance

Kanpredict guarantees delivery that meets clearly defined acceptance criteria within the agreed timeline (24 hours for single repository, with delivery time calculated as n + (n-1) days for multiple repositories where n is the number of repositories). After the pull request is delivered, validation, integration, and final acceptance are your responsibility.

Bug Fix Guarantee: Kanpredict provides 30 days of free bug fixes for any issues directly related to the delivered feature code, starting from the delivery date.

5. Money-Back Guarantee and Refund Policy

A full refund is available if:

• the delivered feature clearly fails to meet the agreed acceptance criteria, or
• Kanpredict misses the guaranteed delivery deadline.

If Kanpredict misses the guaranteed delivery deadline, you will receive either a $200 credit towards future features or a full refund at your discretion.

Refund requests must be submitted within 14 calendar days of the delivery. Approved refunds are processed within 14 business days.

5.1 Abusive Refund Requests

Kanpredict may refuse refund requests deemed excessive, unjustified, or fraudulent and may terminate future service availability to the requester.

6. User Responsibilities

You must supply accurate, complete, and timely information, including clear feature descriptions and repository access. Kanpredict is not liable for delays or failures caused by incomplete or inaccurate data.

7. Intellectual-Property Rights

Upon confirmed payment and delivery, all IP rights to the developed feature transfer to you. Kanpredict retains no rights after transfer.

8. Intellectual-Property Indemnification

You warrant that all materials you provide do not infringe third-party rights and agree to indemnify Kanpredict against related claims.

9. Kanpredict's Right to Terminate

Kanpredict may suspend or terminate services at its discretion if no tasks or payments are outstanding. Notice will be sent via email.

10. Data Privacy, Security, and Confidentiality

We use your data solely to fulfil your request, protect it with encryption and best-practice security, and never sell or share it except when required by law.

11. Limitation of Liability

Kanpredict's liability is limited to the total amount paid for the specific feature involved. We are not liable for indirect, incidental, or consequential damages.

12. Modifications to Terms

Kanpredict may revise these Terms at any time. Users will be notified by email or platform notice. Continued use constitutes acceptance of changes.

13. Governing Law and Jurisdiction

These Terms are governed by Delaware law. All disputes shall be resolved exclusively in Delaware courts.

14. Entire Agreement

These Terms supersede all prior agreements and communications between you and Kanpredict.

15. Customer-Satisfaction Commitment

Kanpredict seeks amicable, reasonable solutions to all client concerns.

16. Severability

If any clause is held unenforceable, the remaining provisions remain in force.
